Declaration of Homestead

of Dated October 7th 1870

Nathaniel Smith & wife

Know all names by these presents:

That we Nathaniel Smith of the County of Mendocino and State of California
and Caroline Smith his wife do hereby select, set apart and dedicate as a
homestead under the provisions of an Act entitled. An act to amend "An Act
to exempt the Homestead and other property from forced sale in certain cases
passed April 21st 1851. approved April 28th 1860 and the Act-thereby amended
and the act-or acts amendatory thereof, the following describes tract or
parcel of land, lying,being and situate adjacent - or near to and
Northeasterly of the town of Mendocino in Big River township,County of
Mendocino and State of California and being bounded and described as
follows, to Wit: ____________________________________Beginning at a point on
the Northerly line of the Big River and Little Lake road, from which point
the North East corner of J.B. Fords garden tract on the South side of said
road bears (S 66 1/4 o ?) W. distant there from 13.28 chains,thence from
said point of beginning (N 81o E, on Northerly boundary of said road and on
a line distant-sixty (60) feet-from and parallel with the fence on the
Southerly side of said road. Two (2) chains to a point from which the
point-where the line fence and boundary becomes the land of D.B. Milliken,
formerly, as the Harry Johnson place. and the land of D.J. Lansing
intersects or strikes the fence on the Southerly side or line of said Big
River and Little Lake road, bears N 83 1/2 o E. distant there from fifteen
67/100 (15.67) chains thence N go W five (5) chains, thence S 81 o W two(2)
chains, thence S go E five (5) chains to the point of beginning and
containing one acre_______________________________________________

And we do here by declare in writing that we have selected said property as
a homestead, and that it is our intention to use and claim the 3 Acre as
such homestead, and that we are at the time of making this declaration
residing with our family on said primises, ______________________________

In witness whereof we have here unto let our hands and seal at the County of
Mendocino and State of California this seventh day of October A.D.

On this Seventh day of October before me William Heeser a Notary Public in
and for said County duly comissioned and sworn personally appeared Nathaniel
Smith and Caroline Smith his wife whose names are subscribed to the annexed
instrument as parties hereto , personally known to us to be the individuals
described in and who executed the 3 acre and each acknowledge and
voluntarily for the uses and purposes therein mentioned. And I do further
certify that the said Caroline Smith was by me first made acquainted the
contents of said instrument, and thereafter acknowledged to me in
examination apart from and without the hearing of her husband that she
executed the 3 acre freely and voluntarily without-fear, compulsion or under
influence of her husband, and that she did not wish to retract the execution
of the 3 acre,_________________________
