291. Mary Peyton was born about 1737 in Virginia Colony, Culpeper Co. (prob.).1145 She was listed in the in USA, Kentucky, Nelson Co. tax list on 30 November 1792 Smith Mary Nelson 11/30/1792
She died about 1795 at the age of 58 in USA, Kentucky, Nelson Co..1145 Mary signed a will in 1795 in USA, Kentucky, Nelson Co..1145 Will Book A. Witnessed by John Stone and Bryan Stone.

Her son William Smith is mentioned.

Mary Smith's final settlement in Nelson co. Will Book A. It lists what her heirs received and her daughter's portions are listed under their husband's names. This includes Peter Dewitt. To me, this is conclusive evidence the Nancy Brown who married Peter Dewitt with Mary Smith's consent is the same as the Ann Dewitt listed in her will. even the portions received conform to Mary's will with the exception of extra payments made separately for son William Smith and Hannah Dewitt which I think are some of Mary's "just debts". As with her other sisters, Hannah Orr Devore Dewitt's portion according to Mary's will is listed under her husband's name, Jacob Dewitt. Mary's maiden name was Peyton and her first husband was Samuel Orr, see the Culpeper County, Virginia Will Book A.


Jacob Dewitt and Peter were sons of a Jacob Dewitt Sr., as shown in a power of attorney to Zachariah Price Dewitt registered in the Sussex County, New Jersey Deeds. Secondary sources in Butler County, Ohio say Zachariah was a brother to Jacob and Peter Dewitt. I have been unable to verify this. I am still trying to figure out Nancy Brown's maiden name. My best guess is she was an Orr and married a Brown who died soon after they married. Perhaps the James Brown who shows up in an early Nelson County Tax (tithables) list among Mary and her children.

From Kentucky land grants: Samuel Orr Received a land grant in Kentucky, Christian Co. on Little River for service in the Revolutionary War. Record # 0250.0. DAR states that Samuel was born April 17, 1759 in Virginia. His wife was named Charlotte and he died 8 June, 1817 in Kentucky. This death date is probably an error since he appears on 1820 census.

Hannah Orr was born before 1767. Another interesting thing is that Hannah Orr who married Jacob Dewitt was first married to Price Devore in Nelson, KY. It is not known who Price Devore was. With the name "Price", he was probably a descendant of James Jacobus Devore and Elizabeth Price. He was listed in the Kentucky Census in 1790 in Nelson County and 1792. Nelson, KY is where Zachariah Dewitt was located from the 1780's to about 1805 and "Ben Fouler" was there in 1791. In 1800 Jacob Dewitt was also in Nelson, KY. Listed with him were James and Peter Dewitt. At this time most of the Devores in KY were in Bracken and Mason County. These counties are in the northern section of Kentucky near the Ohio border. But the Fowlers were south of them in Madison, KY until at least 1800, so it's not clear if, when or where they met up to make the crossing into Ohio.
